1. Acceptance of Conditions

The General Terms and Conditions of Use set out the general terms and conditions of use of the "www.eduacces.ro" site by potential visitors or beneficiaries.

"www.eduacces.ro" (hereinafter referred to as "Site", "Platform") is an online integrated platform developed by FDP – FDP-Protagonists in education Association (hereinafter referred to as "FDP") which acts as a digital aggregator of free educational resources for teachers working with children with SPED needs, with a helpline provided by psychologists with whom teachers can come into contact to discuss special cases and obtain advice and help.

FDP is a legal person, based in Bucharest, Str. Albești nr. 14, sector 2, registered in the Register of Associations and Foundations of the District Court 2 in Bucharest under No 24/29.08.2018, CIF 9019287.

The use of THE PLATFORM requires full acceptance of the terms and conditions set out below.

2. The Objective of the Site

The objective of the Site is to be an integrated Platform which aggregates free educational resources for teachers working with children having SPED needs, with a helpline provided by psychologists with whom teachers can come into contact to discuss special cases and get advice and help.

3. Conditions of Access

Users' access to the services and information within the PLATFORM is protected by a "user name" and a "password". We recommend that you do not disclose your access details to anyone. The Platform will never ask for your access data through unsolicited messages or phone calls. Do not disclose this data to people who ask you to do so. Furthermore, you are required to periodically check that the access data has not been tampered with and report any malfunction to the Platform administrators as soon as possible.

In order to use these services, you must: (a) communicate real, accurate, current and complete personal information as required in the registration forms and (b) update the Personal data as many times as necessary to maintain this real, accurate, current and complete information.

If you provide false, inaccurate, out-of-date or incomplete information, or there is a suspicion that the information is false, inaccurate, out-of-date or incomplete, the Platform administrator has the right to temporarily or permanently suspend your user account.

The "user name" and "password" for new users will be automatically generated by the platform administrator, based on the Personal data provided at the time of the registration. This data will be communicated to each user by e-mail.

Users can request support concerning the "user name" at the following email address: contact.eduacces@gmail.com.

Users are obliged to sign messages with their full name and to indicate their profession and their workplace.

The administrator will respond to requests received by email within 48 hours of receipt. The administrator has the right to archive any email or telephone communication with the users of the platform.

We recommend that you sign out your account at the end of each session using the Sign out button. We also recommend to close the browser window at the end of each session.

4. General Practices of Use and Data Storage

The Platform may establish a set of general practices and limitations concerning the use of the services. Thus, the maximum size of a file that can be uploaded to the server is 5 MB.

5. Content

By this Agreement, you accept that all information: data, text, software, photos, charts, messages or other materials (hereinafter referred to as the 'Content'), whether publicly displayed or individually, privately transmitted, is entirely the responsibility of the person who was the source of these materials. This means that you, and not the Platform, are entirely responsible for all the material you upload and make publicly available to your account in the Platform.

The Platform monitors, but does not control, the content transmitted, and thus does not guarantee the accuracy, integrity and quality of that content.

You agree not to use the services provided by the Platform to:

• upload, post or transmit messages whose content is illegal, defamatory, offensive, threatening, abusive, abusive or discriminatory;

• pretend to be another person or institution, including, but not limited to, a representative of the Platform, a leader or a mediator of a discussion or to falsely assert or otherwise indicate the affiliation with a particular person or institution;

• falsify identification data or otherwise manipulate it for the purpose of disguising or concealing the origin of any content transmitted through the Platform or develop hidden pages or images (such as those that have no active link on a user's page);

• upload, post, broadcast or transmit any content for which you do not have the legal right to transmit or broadcast;

• upload, post, broadcast or transmit any type of content that infringes a protected patent or trademark, trade secret, copyright or other property rights of any third party;

• upload, post, broadcast or transmit any type of advertising, promotional materials, commercial offers, political information, 'junk mail', 'spam', chain letters, pyramid schemes or any other form of requests, except for portions of the service that are formed for this purpose;

• upload, post, broadcast or transmit any material containing viruses or any other type of code, file or program designed to destroy, interrupt or limit the operation of any other software, hardware or telecommunications equipment;

• intervene in or interrupt services/servers/networks connected to the Platform;

• intentionally or not violate any local, national or international law, including, but not limited to, any regulation that has the value of the law;

• promote or provide information on how to conduct illegal activities;

• use your personal page or directory as your own place of storage to load the page from a different link than the one existing within the Platform, or as a means of accessing another personal site.

According to the legislation in force, the owner of the Platform has the obligation to immediately inform the competent public authorities of any seemingly illegal activities that are carried out by the recipients of its services or any seemingly illegal information provided by the website’s users.

6. Intellectual Property Rights

The Platform allows the user to use a specific space to store documents for their personal use or to make them available to other people. All posted, transmitted or contained information on the Platform, including, but not limited to, menus, articles, texts, photographs, illustrations, audio and video recordings, service marks, is protected by copyright and intellectual property laws.

The content is owned by the Platform and its authorized users.

The user may use copies, distribute and transmit the contents only as part of the use of the author's Personal data and with the author's consent. The User agrees not to modify, post, transmit, transfer, sell, reproduce, distribute, provide, expose or commercially exploit any content in any way or infringe the manufacturing mark or service mark contained in such content.

Copyright for information signed by FDP-Protagonists in education Association is owned by FDP –Protagonists in education. No material on this site may be partially or fully reproduced or modified without the express consent of the FDP – Protagonists in education, the holder of this right.

7. Links to Other Websites

The Platform may contain links to third-party websites. The ability to create these links is given to the user as an advantage; The Platform has no control over the third-party websites.

The Platform is not responsible for the availability of these external sites, does not support and is not responsible for their content (advertising, products or other materials on or available on such sites).

8. Changes to General Terms and Conditions of Use of the Site

The 'General Terms and Conditions of Use' constitute, in full, an agreement between you and the FDP-Protagonists in education Association regarding the use of this Platform.

The terms and conditions may be changed at any time by the administrator of the Platform, without prior notification of the persons using it, hereinafter referred to as 'Users'. The users will have permanent access to the terms and conditions for using the services so they can consult them at any time. If they do not agree to the conditions imposed, Users must stop accessing the Platform.

9. Termination of Collaboration

You agree that the Platform, if it deems it appropriate, may block your access, use of services or use of any other services you benefit from or remove and delete any content within the Services for any reason, including but not limited to, the lack of use or if the Platform believes that you have violated or not acted according to the letter or the spirit of this Agreement.

You agree that your access to the services provided under any rule of this Agreement may terminate without prior notification, and you acknowledge and agree that the Platform may immediately disable or delete files and any related information from your personal account and/or prohibit any subsequent access to such files. Furthermore, you agree that the Platform will not be liable to you or any third party in any way for prohibiting and/or deleting your account and access to the services made available through it.

10. Limitation of Liability

By this Agreement, the Platforms assumes no liability if certain information is provided late, is lost, is deleted, or cannot be stored or cannot be accessed on our servers for any reason. The Platform assumes no responsibility for the consequences that may arise due to the delay, loss or inaccuracy of the information posted or existing on the Platform.

Users will use the information provided within the PLATFORM on their own responsibility, and in the event of damage arising from the use of the services or information provided, users accept that the Platform will be absolved of any liability.

All rights are reserved.

It is strictly prohibited to use this Site for the purpose of destroying or altering it, its content or security, or to discredit or harass users of the platform or the FDP – Protagonists in education.

The FDP shall apply all technical and organizational security measures to protect the data under its control against any instance of accidental or intentional manipulation, loss, destruction or access by an unauthorized person.

11. Compensation

You agree to compensate and protect the Platform from any claims or requests, including legal costs or fees, made by a third party or organization due to or arising from personal content or due to the use of the services available on the Platform, to violation of this Agreement or of any of the rights of the third party.

By filling in the registration form and creating your account, you agree to the General Terms and Conditions, you accept them and consent to them. By creating your affiliate account, you agree to the General Terms and Conditions, you adhere to the FDP's Personal data Processing Policy, you accept it and consent to it.

Failure to read the Terms and Conditions and the Personal Data Processing Policy cannot be invoked in any form or on any occasion.

Personal Data Processing Policy

Starting the 25th of May 2018, the new General Data Protection Regulation (GDPR) came into force - 679 of 2016. GDPR regulates both the activity of Personal data collection, storage and processing by operators and economic agents or public institutions, as well as the protection of your Personal data. We kindly request you to read this material to the end, so that your decisions will be made knowing what Personal data FDP – Protagonists in education processes for the purpose of: issuing diplomas and certificates, developing and providing products and services, maintaining communication with you. The GDPR applies in all member states of the European Union. The regulation also applies to you as a visitor or user of the eduacces.ro platform.

The safety of your Personal data is important for the FDP – Protagonists in education. We would like to inform you that we comply with Regulation (EU) 2016/679 on the protection of individuals with regard to Personal data processing and on the free movement of such data and the repealing Directive 95/46/EC, in Personal data collecting, processing, transmitting and retaining, and we confirm you that your Personal data is safe.

By filling in the forms made available on this website, we may collect the following Personal data (hereinafter referred to as "Personal data"):

• First and last name;

• City of residence;

• E-mail address;

• Profession;

• Workplace;

• Phone number;

• TBA.

The purpose of processing this information is to be able to guarantee access to the logged in users to restricted content of the Platform and to allow the download and use of material available on the platform and to maintain communication with you (through market research and surveys, newsletters, information about services or products changes, sending valuable content for you).

Personal data collected through document submission forms to FDP – Protagonists in education, is used for assigning copyright of materials to their rightful author.

Personal data collected through the platform specialist account creation form are used to create user accounts and to provide additional permissions and Helpline services to users and access to the platform management panel for these specialists hosted at contact.eduacces@gmail.com.

Creating an account on the Platform does not involve the automatic subscription to the newsletter database of the Platform.

In order to be able to subscribe to the subscriber database of the Platform you will need to register using the form available on the website. The newsletter is managed through the Mailchimp mailing service. FDP – Protagonists in education may use the personal data collected to communicate with its users strictly on matters related to their user accounts.

We would like to inform you that you have the following rights regarding your personal data that we fully respect:

■ Right to information;

■ Right of access to data;

■ Right to data correction;

■ Right to delete the data ("the right to be forgotten”);

■ Right to restrict processing;

■ Right to data portability;

■ Right to object;

■ Right not to be subject to an automatic individual decision;

■ Right to apply to the National Supervisory Authority for Personal Data Processing or to the competent courts.

FDP – Protagonists in education is obliged to manage your personal data safely and only for the specified purposes and for the pursuit of purpose-specific activities and assures the data subjects that the organization has sufficient procedures concerning Personal data processing and that the staff responsible with data processing are sufficiently trained.

Thus, you have the right to request access to your processed Personal data whenever they are modified, corrected, restricted or deleted. You have the right to be forgotten. You have the right to object to the Personal data processing. If this is the case, we cannot guarantee you the issue of diplomas and certificates, the supply of conforming products and services or the uninterrupted communication with you. Also, you can always request the deletion of the data, except otherwise required by the law. You have the right to data portability. Thus, you can choose to transmit your Personal data to another operator. Also, Personal data processing targeting minors will be carried out under the conditions of compliance with the law. You have the right to file a complaint with a supervisory authority.

Personal data may be disclosed to public authorities (the Police, Public Prosecutor's Office, courts, etc.) on the basis of the legal provisions, following firm requests by the authorities. Personal data are disclosed to founders, national and international partners of the FDP – Protagonists in education, but only when strictly necessary for the successful implementation of the AcCES project.

At your request, we can confirm whether or not your personal data is being processed. You can also change your own Personal data. You may object to the processing of your personal data or request the deletion of your personal data.

If you do not agree to the terms and conditions specified in this terms and conditions agreement, then we request you to stop using our products and services. By filling in the registration form and by creating your account, you agree to the General Terms and Conditions, you accept them, and you agree to them. By creating your affiliate account, you agree to the General Terms and Conditions, you adhere to the FDP's Personal data Processing Policy, you accept them, and you agree to it.

Failure to read the present Terms and Conditions and the Policy of Personal Data Processing cannot be invoked in any form or on any occasion.
